Terms of Use and End User License Agreement

Effective Date: July 17th, 2026

These Terms of Use and End User License Agreement ("Terms") govern your access to and use of the BettorIndex mobile application and related services (collectively, the "App") provided by BettorIndex ("we", "us", or "our"). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

On iOS, these Terms supplement Apple's Standard Licensed Application End User License Agreement where applicable. On Android, Google Play does not provide a default app-specific end user license agreement; these Terms define your license to use the App. Your use of the App is also subject to the applicable app store's terms (Apple Media Services or Google Play Terms of Service) and our Privacy Policy.

1. Acceptance

By using the App, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms. If you use the App on behalf of an organization, you represent that you have authority to bind that organization.

2. License Grant and Restrictions

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use.

A paid subscription entitles you to access paid features only for the active billing period. It does not grant you a perpetual license to any content, data, or materials displayed in the App.

You may not:

Copy, modify, adapt, translate, or create derivative works of the App or its content.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where applicable law expressly permits.
Rent, lease, lend, sell, sublicense, redistribute, or make the App or its content available to any third party.
Circumvent, disable, or interfere with subscription checks, paywalls, or access controls.
Use the App for any unlawful purpose or in violation of applicable gambling or gaming laws in your jurisdiction.
Scrape, bulk-export, or systematically harvest data from the App for resale, redistribution, or to build a competing product or service.

3. Intellectual Property

The App, including its name, logo, user interface, design, software, algorithms, scoring logic, text, graphics, and other content, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you. Trademarks, logos, and names of sportsbooks, leagues, teams, and other third parties belong to their respective owners.

4. Term and Termination

These Terms remain in effect while you use the App and comply with them. If you have a subscription, your license to paid features continues only while your subscription is active and in good standing.

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or if we discontinue the App or any feature. You may stop using the App at any time. Upon termination, your license ends and you must cease use and uninstall the App. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

5. Updates and Support

We may release updates, patches, or new versions of the App. Some updates may be required for continued use. We are not obligated to provide maintenance, support, or new features. Updates are subject to these Terms unless we provide separate terms that you accept.

6. No Betting or Gambling

The App provides analytics and information for entertainment and informational purposes only. We do not operate a sportsbook, accept wagers, or encourage gambling. We do not guarantee any outcome, edge, or profit. Users are solely responsible for any decisions they make, including any wagers placed with third-party sportsbooks, and for complying with applicable laws in their jurisdiction.

7. No Artificial Intelligence Features

BettorIndex does not currently use artificial intelligence, machine learning, or generative AI to produce content, recommendations, or responses within the App. Analytics, trends, and leans are derived from structured sports and odds data and fixed rules — not from AI models. If we introduce AI-powered features in the future, we will update these Terms and our Privacy Policy before or at launch.

8. Subscriptions and Payments

Subscriptions and in-app purchases are processed by the platform store through which you obtained the App (Apple App Store or Google Play), not directly by us. You agree to the applicable store's terms and policies.

Shared terms (iOS and Android)

Auto-renewal: Subscriptions renew automatically unless you cancel before the end of the current billing period.
Pricing: We may change subscription prices. The store will notify you where required by its policies.
Refunds: Refund requests are handled solely by Apple or Google in accordance with their respective policies. We do not process refunds directly.
Trials and intro offers: If offered, free trials or introductory pricing convert to a paid subscription unless you cancel before the trial or introductory period ends, as described at purchase.
No guaranteed access: Payment of a subscription fee does not guarantee uninterrupted access, availability of any particular sport, market, sportsbook, data feed, or accuracy of any output.

Apple App Store (iOS)

Billing is through Apple. Manage or cancel your subscription in Settings → Apple ID → Subscriptions.
To avoid renewal, cancel at least 24 hours before the end of the current billing period.

Google Play (Android)

Billing is through Google Play. Manage or cancel your subscription in Google Play → Payments & subscriptions → Subscriptions (or the equivalent in your Play Store app).
Cancel before renewal in accordance with Google Play's billing cycle rules.

9. Service Availability

The App and all data, features, and content are provided on an "as available" basis. We do not guarantee any minimum uptime, availability, response time, or performance level.

The App may be unavailable, delayed, or limited at any time, with or without notice, due to maintenance, updates, bugs, capacity limits, network failures, device or operating system issues, or outages or changes at third-party data providers, sportsbooks, or infrastructure partners. We may modify, suspend, or discontinue any part of the App at any time.

10. Data and Analytics Accuracy

Sports statistics, odds, lines, trends, leans, hit rates, and "best available" prices depend on third-party sources and our processing logic. This information may be delayed, incomplete, incorrect, outdated, or unavailable. Odds and lines change frequently and may differ from what is shown in the App at the time you place a wager.

You are solely responsible for verifying all lines, prices, rules, and eligibility with your sportsbook before wagering. Historical performance, trends, or hit rates do not predict future results.

11. Third-Party Services

The App relies on third-party APIs, data providers, and platform services. We do not control and are not responsible for the accuracy, completeness, timeliness, or availability of third-party data or services. Features may be unavailable or inaccurate if third-party services are interrupted, changed, or discontinued. Your use of third-party sportsbooks or other services is governed by their terms, not ours.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA OR OUTPUT WILL BE ACCURATE OR RELIABLE.

Some jurisdictions do not allow the exclusion of implied warranties; in those jurisdictions, the above exclusions apply to the fullest extent permitted by law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR WAGERS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP OR ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BettorIndex and its affiliates, officers, directors, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your reliance on any content in the App.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted in the App and/or on our website with an updated effective date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and cancel any active subscription through your app store.
